2. The petitioners apprehend their arrest in a case registered for the offence under Sections 126(2), 115(2), 117(2), 109, 303(2), 351(2), 352, 3(5) of the Bhartiya Nyaya Sanhita.

3. As per F.I.R., on the alleged date and time of occurrence, these petitioners, who are named in the F.I.R., alongwith one co-accused assaulted informant and his grand son, due to which, both of them sustained injuries.

Learned counsel for the petitioners submits that both parties are pattidars and there is admitted land dispute between them and a title suit, vide Title Suit No. 21 of 2012, is already pending in the Court below. Allegation of assault is general and omnibus and no specific allegation of overt act has been alleged against these petitioners. Case and counter case. Petitioners claim clean antecedent.

5. Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - I, Bikramganj, Rohtas in connection withSuryapura P.S. Case No. 357 of 2024, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.
