JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-03-2019 This application, for grant of anticipatory bail, arises out of Motihari (Town) P.S. Case No. 746/18, disclosing offences under Sections 406, 420, 379 and 120B of the Indian Penal Code.

Allegation is of commission of theft of vehicle of the Tata Safari vehicle of the petitioner.

Submission of learned counsel for the petitioner is that he has been made accused in this case only on the basis of suspicion and except that there is nothing against the petitioner. Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case and the nature of accusation, I am not inclined to grant the privilege of anticipatory bail to the

Patna High Court CR. MISC. No.14256 of 2019(2) dt.07-03-2019 2/2 petitioner rather he should surrender and make prayer for regular bail and if any such application is filed, the court below shall dispose of the same on the merit of the case, without being prejudiced by the order of this Court.

With the above observation, this application is dismissed.
