Accordingly, the application with regard to petitioner no.4 is dismissed as withdrawn.

Heard learned counsel for petitioner nos.1, 2 and 3 and learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Ramnagar P.S. Case No.26 of 2023 registered under Sections 30(a), 30(b), 30(c), 34(a) and 36 of the Bihar

Patna High Court CR. MISC. No.18329 of 2023(2) dt.05-05-2023 2/2 Prohibition and Excise Act.

Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. Nothing has been recovered from possession of the petitioners rather the alleged recovery of illicit liquor has been made from sugarcane field of Sugreev Yadav. The petitioners have got no criminal antecedent.

Having considered the above facts and circumstances of the case and the submissions advanced on behalf of the parties, let the above named petitioner nos.1, 2, and 3 be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bonds to the satisfaction of Special Judge, Excise, Bagaha, West Champaran in connection with Ramnagar P.S. Case No.26 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Arvind Srivastava, J) Harish/- U T
