The petitioner apprehends his arrest in Roh P.S. Case No. 78/2014, registered for the offences punishable under Section 427, 436 of the Indian Penal Code and Section 27 of the Arms Act.
The informant alleged that Navin Singh informed that Pankaj Singh, Manish Kumar, Vinay Singh and Mohan Kumar (petitioner) set ablaze his Bolero Car.
It is submitted that the informant is not an eye-witness of the occurrence. There is a case and counter case. Similarly situated co-accused Pankaj Singh and Manish Kumar had already been granted bail by a coordinate Bench of this court vide order passed in Cr. Misc. 56430/2015. The case of the petitioner stands on
Patna High Court Cr.Misc. No.16360 of 2016 (2) dt.10-05-2016 2/2 similar footing.
Considering the facts aforesaid and the fact that similarly situated co-accused had already been granted bail and the case of the petitioner stands on similar footing, the petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sujeet Kumar, learned Judicial Magistrate, Ist Class, Nawada in connection with Roh P.S. Case No. 78/2014, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
