The petitioner apprehends his arrest in Jehanabad P.S. Case No. 562/2015, registered for the offences punishable under Sections 448, 354B of the Indian Penal Code.
The petitioner is alleged to have entered into the house of the informant finding his daughter alone and made attempt to outrage her modesty.
It is submitted that the petitioner and informant are neighbours and gotiyas. There is land dispute between them for which this false case has been lodged against the petitioner. Considering the facts aforesaid and the nature of allegation made against the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is
Patna High Court Cr.Misc. No.16488 of 2016 (2) dt.12-05-2016 2/2 rejected.
However, the petitioner, if so advised, may surrender before the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail and his prayer shall be considered on its own merit without being prejudiced by this order.
