The petitioners are languishing in custody for the offences punishable under Sections 272/273/414 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Huge quantity of liquor was recovered from the house under construction of the petitioners. The petitioners have stated on oath that they have got no criminal antecedent. They are in custody since 12.02.2020.

Considering the entire facts, let petitioner No.1 Krishna Manjhi, who is aged about 70 years, be released on

Patna High Court CR. MISC. No.13725 of 2020(2) dt.29-02-2020 2/2 bail at once and petitioner No.2 Dablu Kumar @ Dablu Manjhi, be released on bail after framing of the charge on furnishing bail bond of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Gopalganj Town (Nagar) P.S. Case No.461 of 2019, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners. (Birendra Kumar, J) Mkr./- U T
