2. The petitioners have prayed for regular bail in a case registered for the offence punishable under sections 189(2), 126(2), 115(2), 333, 125(a), 125(b), 303(2), 74 and 351

(2) of the BNS an Sections 4 & 5 of the POCSO Act.

3. The case of the prosecution is that when the daughter of the informant was coming from the shop after

Patna High Court CR. MISC. No.16629 of 2025(2) dt.11-04-2025 2/3 purchasing sugar, on the way, one Rakesh Kumar molested her daughter. It is further alleged that when the informant went to complaint, the petitioner along with others started assaulting. Hence, the present FIR.

4. Learned counsel for the petitioners submits that the petitioners are innocent and has falsely been implicated in connection with the present case. It is further submitted that the main thrust of allegation is against co-accused, namely, Rakesh Kumar. Further submission is that the petitioners are family members of Rakesh Kumar and the only allegation against them is of assault. Moreover, the petitioners are languishing in judicial custody since 26.12.2024 having no criminal antecedent.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Special POCSO Case No. 162 of 2024 arising out of Shakurabad P.S. Case No. 341 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned
