JUSTICE SUDHIR SINGH ORAL ORDER 03-05-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is apprehending his arrest in connection with Bhabua P.S. Case No. 123 of 2016 for the offences instituted under Sections 166, 175, 176, 420 and 406/34 of the IPC. The prosecution story, in brief, is that in view of the order dated 18.01.2016 of the Hon'ble High Court, the certificates of newly appointed teachers of Primary School were required to be produced for verification and in this regard, order was passed by District Education Officer whereby Panchayat Secretaries were directed to produce folders of newly appointed teachers, but documents were not produced for verification, petitioner is

Patna High Court Cr.Misc. No.15626 of 2016 (2) dt.03-05-2016 2/2 custodian of those documents.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. He has been made accused in the present case due to mistake of fact. The relevant documents in respect to appointment of Assistant Teachers have not been handed over to him by his predecessor. The other coaccused has been granted anticipatory bail by this Court vide Cr. Misc. No. 17007/2016.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Bhabua P.S. Case No. 123/2016 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Kaimur at Bhabua, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
