JUSTICE SUDHIR SINGH ORAL ORDER 13-05-2019 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner seeks bail in a case registered under Sections 147, 148, 149, 323, 324, 307, 379, 448, 504 of the Indian Penal Code and Section 302 of I.P.C. has been added. Allegation is that the accused persons including the petitioner assaulted on the head of the brother of the informant by means of rod, as a result of which he fell down unconscious. It has been submitted on behalf of the petitioner that the petitioner is in custody since 3.2.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. After investigation

Patna High Court CR. MISC. No.14650 of 2019(4) dt.13-05-2019 2/2 the police had submitted final form against the petitioner. The court below has differed with the said police report and taken cognizance for an offence under Section 307 of I.P.C. against the petitioner also. The counsel for the petitioner assures that the petitioner will co-operate during trial.

On behalf of the State and learned counsel for the informant, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional Sessions Judge, West Champaran at Bettiah in connection with Sessions Trial No.608 of 2018 arising out of Sathi P.S. case No.179 of 2015.
