This application is for grant of regular bail in connection with Siwan (Town) P.S.Case no.241 of 2017, registered for the offences punishable under Sections 420, 467, 468, 471 and 120B of the Indian Penal Code.

Allegation against the petitioner and other accused persons, as per FIR, is of exchanging the Card of the informant and other co-accused persons have withdrew Rs.75,000/- and odd but when the informant realized of the same, he made 'hulla' and thereafter the police party arrested two of the accused persons including the petitioner and two others succeeded in fleeing away. Submission of the learned counsel for the petitioner is that he has been made accused in this case only on the basis of

Patna High Court Cr.Misc. No.39298 of 2017 (2) dt.22-08-2017 2/2 suspicion and nothing has been recovered from his possession and he has no criminal antecedent.

Heard learned A.P.P. also, who has opposed the prayer for bail on the ground that the petitioner was arrested on chase Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner, however, he may renew his prayer for bail before the court concerned after framing of charge in this case. With the aforesaid observation, this application is dismissed.
