JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-04-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323,427,385 and 386/34 of the Indian Penal Code and section 3 of Prevention of Damage to Public Property Act.

The prosecution case is that that the petitioner and co accused Pradeep Yadav were cutting the PCC road when the informant made protest then the petitioner and co accused Pradeep yadav damaged the name plate of MLA with spade. When the informant protested, the petitioner and co accused demanded extortion of one lakh rupees from the informant and out of fear the informant paid rupees twenty thousand to co accused Pradeep. It is submitted by the learned counsel for the petitioner

Patna High Court Cr.Misc. No.17512 of 2016 (2) dt.26-04-2016 2/2 that the accusation has been levelled due to political rivalry since the wife of the informant is Panchayat Mukhia when the petitioner also contested for the said post. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Madhepura in connection with Shankarpur P.S. Case No. 17 of 2016 subject to the conditions as laid down under Section 438(2) Cr.P.C.
