JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 02-09-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. The petitioner seeks bail in connection with Naubatpur P.S. Case No. 17 of 2019, registered under Sections 384, 386, 387 and 506/34 of the Indian Penal Code and Section 27 of the Arms Act.

The accusation is that informant Sudhanshu Kumar started to run New Garden Public School within the campus of Ideal Coaching Institute, Amarpura. On 10.01.2019 at about 3.30 P.M., while informant was in the school campus then heard the sound of firing at the gate of the school. Thereafter, he saw out side towards gate then saw 6 to 7 round firing at the gate then he entered in the room. The persons, who indulged in firing, asked all staffs of Ideal coaching to

While informant tried to know about the occurrence from manager and other staff of Ideal coaching Institute, but clue was not given. Learned counsel appearing for the petitioner submits that it would appear from the F.I.R. that on the basis of written report of Sudhanshu Kumar, Naubatpur P.S. Case No. 17 of 2019 was registered under Sections 384, 386, 387 and 506/34 of the Indian Penal Code and Section 27 of the Arms Act on 10.01.2019, but informant in his restatement disclosed the name of six persons, including the petitioner, mere on suspicion having hand in the present case and thereafter, petitioner was remanded in this case on 03.10.2019 from Naubatpur P.S. Case No.

412 of 2018. Further submission is that while the petitioner is accused in six cases, as detailed in para 3, but he is on bail in five cases, as detailed in Supplementary affidavit filed through e-mail on 25.08.2020 and the prayer for bail of the petitioner is pending in connection with Naubatpur P.S. Case No. 412 of 2018. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.

Patna High Court CR. MISC. No.13530 of 2020(4) dt.02-09-2020 3/3 Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateII, Danapur in connection with Naubatpur P.S. Case No. 17 of 2019. One sureties must be parents/close relative of the petitioner.
