Petitioner seeks bail in a case registered for the offences punishable under Sections 366(A),376 IPC and Section 4 of the POCSO Act.

The statement of the victim recorded under Section 164 Cr.P.C. would reveal that she had voluntarily gone with the petitioner and she expressed her desire to live with the petitioner.

Though allegation is that the victim was a minor on the date of occurrence but she has not alleged any offence committed by the petitioner, hence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like

Patna High Court CR. MISC. No.25185 of 2021(2) dt.10-09-2021 2/2 amount each to the satisfaction of learned Court below where the case is pending in connection with POCSO Case No.126 of 2020 arising out of Barachati (Mohanpur) Police Station Case No.546 of 2020 with following conditions:

(a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
