This is an appeal under Section 14(A)(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 against the refusal of prayer for bail by the learned Special Judge (S.C./S.T. Act), Saran at Chapra, in connection with Parsa Police Station Case No.45 of 2018 registered under Sections 302,120(B),34 of the Indian Penal Code, Section 27 of the Arms Act and Section 3(2)(va) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.
According to FIR, murder of the husband of the informant was committed in her presence by some unknown male persons.
Patna High Court CR. APP (SJ) No.1630 of 2018 dt.11-05-2018 Allegation against the appellant is that she had threatened in the past. Hence, the occurrence might be result of the conspiracy of the appellant.
Appellant is a female. She is in custody since 23.03.2018.
Considering the aforesaid fact, let the appellant, above named, be released on bail after completion of the investigation on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with the aforesaid case, with condition that the appellant shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the appellant. Accordingly, the appeal stands allowed.
