The petitioner herein seeks anticipatory bail in Makhdumpur P.S. Case No. 212 of 2015, registered under Sections 307, 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

On going through the FIR, it appears that the petitioner reached at the place of occurrence after the offence was committed, and the deceased was hit by means of gun shot. That apart, from Annexure-2, which is counter version of the case, it appears that the accused side has also received injuries at the instance of the petitioner.

Considering the above, I am persuaded to grant the

Patna High Court Cr.Misc. No.17354 of 2016 (2) dt.06-05-2016 2/2 privilege of anticipatory bail, let the petitioner above named, in the event of arrest/surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in Makhdumpur P.S. Case No. 212 of 2015 on condition that one of the bailors shall be his own/close family member. The petitioner shall appear on each date fixed at the trial. In case of default in appearance on two consecutive dates, the trial court shall have liberty to cancel his bail bonds.
