The petitioner is apprehending his arrest in connection with Jhajha P.S.Case No.214 of 2018 , registered for offences punishable under Sections 148, 149, 341, 241, 323, 307, 504 of the Indian Penal Code.

Allegation against the petitioner and other accused persons is of assaulting the informant, causing injury to him. Submission of the learned counsel for the petitioner is that no specific allegation has been attributed nor any specific arm has been attributed; by which he has assaulted and there is case and counter case between the parties and there is land dispute. Furthermore one of the co-accused having similar allegation has been granted privilege of anticipatory bail by a Co-ordinate Bench of this Court, vide order dated 26.3.2019

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Jamui in connection with Jhajha P.S.Case No.214 of 2018 (G.R.No.1669 of 2018), subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid direction, this application is allowed.
