Petitioner seeks regular bail who is in custody since 09.10.2022, in connection with Udwantnagar P.S. Case No. 472 of 2022, FIR dated 09.10.2022, registered for the offences punishable under Sections 8(c) and 21(b) of the NDPS Act. 3.
Earlier the petitioner has moved before this Hon'ble Court in Cr. Misc. No. 8888 of 2023, which was dismissed vide order dated 11.07.2023.

According to the prosecution case, acting on the confidential information, the informant along with patrolling raiding party was waiting at zero mile meanwhile two persons riding on motorcycle upon seeing the police party tried to flee,
Patna High Court CR. MISC. No.26813 of 2024(5) dt.22-11-2024 2/3 who were later apprehended and from their possession 400 grams of heroin like substance, Rs. 9,020/- (rupees nine thousand and twenty only) and a mobile phone were recovered. 5.
It appears from the FIR and seizure list that altogether 400 grams of heroin was recovered from the possession of the petitioner.

Vide order dated 04.10.2024, a report was called for with regard to the stage of the trial and report dated 08.10.2024 of the learned trial Court reveals that out of five chargesheeted witnesses, three witnesses have already been examined and only investigating officer and circle officer are yet to be examined.

The learned Additional Public Prosecutor for the State on the other hand has vehemently opposed the prayer for bail of the petitioner.

Considering the facts and circumstances of the case and in view of the recovery of the commercial quantity and report of the learned trial Court, I am not inclined to enlarge the petitioner on bail in connection with Udwantnagar P.S. Case No. 472 of 2022, pending in the Court of learned Additional Session Judge-I, Bhojpur at Ara.

Prayer is refused.
