The petitioners seek bail in anticipation of their arrest in connection with Bajpatti P.S. Case No. 432/2019 instituted for the offences under Sections 341, 323, 324, 307, 354(B), 504, 506/34 of the Indian Penal Code. The accusation against the petitioners is of assaulting the members of the prosecution party. One Dhiraj Kumar is said to have been injured in the occurrence who has received grievous injuries.
The learned counsel for the petitioners has
Patna High Court CR. MISC. No.13536 of 2020(3) dt.05-10-2021 2/2 submitted that there is a counter version to this occurrence vide Bajapatti P.S. Case No. 434 of 2019. The parties are next door neighbours and because of the land dispute, they have been made accused in this case.
However, regard being had to the nature of injuries suffered by the victim, I am not inclined to grant anticipatory to the petitioner.
The prayer for anticipatory bail is rejected. However, if the petitioners surrender before the Court below and seek bail, their application shall be considered on its own merits taking into account all the above noted grounds and an order shall be passed without being prejudiced by the fact that the present petition on their behalf has not been entertained.
