2. This an application for regular bail on behalf of the petitioner for the offences alleged under Sections 310(2) and 311 of the B.N.S. and Section 25(1-b)a, 26, 27 and 35 of the Arms Act, registered in connection with Begusarai Town PS.Case No. 575 of 2024.

While four miscreants after attempting to commit loot in jewellery shop of the informant fleeing away, they fired at the driver of the informant which hit the glass of the window and the driver became injured by the broken glass of the window. The miscreants while committing loot also fired at the informant's son, who was present in the jewellery shop, but luckily he escaped. When the miscreants were fleeing away the
Patna High Court CR. MISC. No.17581 of 2025(3) dt.13-05-2025 2/3 informant fired which hit at the legs of two miscreants Shammi Kapoor and Chotu Kumar and they were apprehended in injured condition. The name of the petitioner has figured in the confessional statement of the arrested co-accused persons.
4. The learned counsel for the petitioner has submitted that the petitioner is not named in the FIR. He has not been arrested at the spot. Nothing was recovered from his possession and except the confessional statement of the coaccused, which is not admissible in evidence, there is nothing against the petitioner in the entire case diary. The petitioner is in custody since 12.12.2024. He has submitted further that on exactly similar footing co-accused Anand Bharti in Cr.Misc. No. 15109 of 2025 has been granted bail by a co-ordinate Bench of this Court under order dated 02.04.2025.
5. On the other hand, the learned APP for the State has opposed the prayer for bail, but conceded fairly that nothing has been recovered from the possession of the petitioner and his name has figured in the confessional statement of the coaccused persons.
6. Considering the above facts and circumstances, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the
Patna High Court CR. MISC. No.17581 of 2025(3) dt.13-05-2025 3/3 like amount each to the satisfaction of learned CJM at Begusarai in connection with Begusarai Town P.S.Case No. 574 of 2024, subject to the conditions that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
