The petitioners apprehend their arrest in Tekari P.S. Case No. 295 of 2014, registered for the offences punishable under Sections 419 and 420 of the Indian Penal Code. The informant made allegation that she deposited Rs. 2 lakhs for getting her admitted in nursing training institute, but receipt of only Rs. 19,000/- was given to her. She further alleged that she was not allowed to appear in the examination. Learned counsel for the petitioners submits that the informant herself did not appear in the examination or not raised any objection about the receipt issued for less amount. The informant appeared in one examination, but she failed. The institute is recognized and order in this regard has been passed in
Patna High Court Cr.Misc. No.23244 of 2015 (2) dt.08-07-2015 2/2 CWJC No. 13830 of 2013.
Considering the facts aforesaid, the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in Tekari P.S. Case No. 295 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
