JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 14-11-2025 From perusal of the affidavit filed on behalf of the S.S.P., Patna, it is stated that there are nine charge-sheet witnesses out of which, one witness has been examined. It is stated that all the remaining witnesses shall be produced before the learned Trial Court within four months.

2. Heard learned counsel for the petitioner and learned A.P.P. for the State.

3. This is second regular bail petition filed on behalf of the petitioner. Earlier, the petition, filed for grant of regular bail on behalf of petitioner, was dismissed on merit, vide order dated 30.01.2024 passed in Cr. Misc. No. 65087 of 2023.

4. Learned counsel for the petitioner submits that petitioner is in custody since 16.09.2021 and similarly situated co-accused Amit Kumar Singh @ Viru @ Shekhar who has three criminal antecedent has been granted regular bail by a Co-

Patna High Court CR. MISC. No.14990 of 2025(5) dt.14-11-2025 2/2 ordinate Bench of this Court vide order dated 29.11.2024 passed in Cr. Misc. No. 74393 of 2024. Further it is submitted that in view of custody period and slow progress of trial, the petitioner is entitled for bail.

Learned A.P.P. for the State vehemently opposed the bail petition of the petitioner and submitted that as per the affidavit of S.S.P., Patna, the evidence of prosecution shall be produced within four months. Petitioner has got 20 criminal antecedents and the seizure is of commercial quantity of Ganja, therefore, petitioner who is a notorious criminal arrested with loaded pistol is not entitled for bail at this stage.

Considering the facts and circumstances of the case, the allegation against the petitioner, and also considering the aforesaid affidavit filed on behalf of S.S.P., Patna, this Court is not inclined to grant bail to the petitioner at this stage. Accordingly, the instant Cr. Misc. petition is dismissed.

7. However, learned Trial Court is directed to expedite the trial and S.S.P., Patna, in view of the affidavit filed by him, shall co-operate in conclusion of the trial.
