2. The petitioner apprehend his arrest in connection with Tariyani P.S. Case No. 144 of 2023 instituted under Sections 379 and 461 of the Indian Penal Code.

3. As per the prosecution case, it is alleged that on 13.06.2023 in the night hour, the accused person has broken the lock of the informant's shop and stolen 46 mobile phones which was amounting Rs. 9,00,000/- besides this an amount of Rs. 15,000/- in cash was also stolen by the accused person.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case due to one criminal antecedent in which he is on bail. He

Patna High Court CR. MISC. No.18811 of 2024(2) dt.28-03-2024 2/2 further submits that nothing incriminating material has been recovered from the possession of petitioner. Except the confessional statement of the co-accused, there is nothing against the petitioner to link the petitioner in this case. The FIR was lodged against unknown. The petitioner is ready to cooperate in the investigation and trial.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount to each to the satisfaction of the learned C.J.M., Sheohar in connection with Tariyani P.S. Case No. 144 of 2023, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
