The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Section 394 of the Indian Penal Code.
As per allegation in the FIR, the tractor of the informant is said to have been looted from its driver by four unknown Bolero borne criminals overtaking the tractor and assaulting the driver. However, they liberated the driver after 3-4 hours.
It is submitted by learned counsel for the
Patna High Court CR. MISC. No.15298 of 2022(3) dt.02-01-2023 2/3 petitioner that the petitioner is innocent and he has falsely been implicated in the present case. The petitioner is not named in FIR and his name sprang up in this case on the basis of confessional statement of Nirmal Kumar Singh, who has been granted bail passed on 18.07.2019, in Cr. Misc No. 44008 of 2019, by the coordinate Bench of this Court. It is also submitted that petitioner is languishing in judicial custody since 18.03.2021.
Learned APP appearing for the State has vehemently opposed the prayer for Bail.
Having heard learned counsel for the parties and taking into consideration the fact that similarly situated two co-accused persons has been granted bail by co-ordinate Bench of this Court, this Court is inclined to enlarge the petitioner on bail.
