JUSTICE ARUN KUMAR ORAL ORDER 11-05-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 18.12.2017, seeks bail in Kotwali (Tilkamanjhi) PS Case No. 165 of 2005 registered under Sections 467, 468, 471 and 420 of the IPC.

The allegation in brief is that the petitioner produced a photo copy of the service book of his father who superannuated on 31.3.1994 and died on 25.7.1995, in the service book he made some interpolation by making the date of birth "9" from English to hindi in order to seek compassionate that his father died before the age of superannuation.

Learned Counsel for the petitioner submits that even taking the allegation that 9.3.1936, date of birth recorded in English, the date of birth "9" there is interpolation in hindi it does not reduce the date of birth.

Having considered the said facts and circumstances, the petitioner, namely, Shankar Kumar Das @ Pankaj Kumar Rai @ Pankaj Paswan is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Bhagalpur in connection with Kotwali (Tilkamanjhi) PS Case No. 165 of 2005.
