This is an application for bail in connection with Pipra P.S. Case No. 16 of 2017 registered for the offences punishable under Sections 302 and 120B of the Indian Penal Code. Allegation against the petitioner is of causing death of daughter of the informant.
Submission of learned counsel for the petitioner is that except suspicion there is nothing against him and apart from enmity there is no circumstance against the petitioner. Further submission is that co-accused has been granted bail by a coordinate Bench of this Court in Cr.Misc.No. 22330 of 2017, vide order dated 29.6.2017 (Annexure-2) and he is in custody since 6.4.2017.
Heard learned APP and learned counsel for the informant. Learned counsel for the informant has opposed the prayer for bail on the ground that earlier also petitioner has caused
Patna High Court Cr.Misc. No.36096 of 2017 (4) dt.16-10-2017 2/2 death of another daughter of informant and, as such, there is strong circumstance against the petitioner.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-III, Supaul, in connection with Pipra P.S. Case No. 16 of 2017, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties in the jurisdiction of court concerned, (2) Petitioner shall co-operate in disposal of trial and appear on each and every date in court and on failure to appear on two consecutive dates without any genuine reason or without permission of court, his bail bond shall be cancelled.
