Petitioner seeks regular bail in connection with a case registered for the offence punishable under sections 302, 307/34 of the Indian Penal Code.

Earlier the bail of the petitioner was rejected vide order dated 17.08.2019 passed in Criminal Miscellaneous No. 31896 of 2019, as contained in Annexure 1 with a direction to the court below to conclude the trial within six months and if trial is not concluded within six months, petitioner would be at

Patna High Court CR. MISC. No.13606 of 2020(3) dt.07-09-2020 2/3 liberty to renew his prayer for grant of bail. It is submitted on behalf of petitioner that on account of dispute of passage between informant's family and petitioner's family, incident happened in which it is alleged that petitioner assaulted the mother of informant by spade and she died during treatment and further allegation of assault is on other family members also. All family members of petitioner has been made accused.

Petitioner has a clean antecedent and he is in custody since 21.7.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail on furnishing bail bond of Rs. 20,000/- with two sureties of the like amount in connection with Naubatpur P.S. Case No.342/2018 to the satisfaction of learned court below where the case is pending, subject to the following conditions:-

(1) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and his absence on two consecutive dates without proper and valid reason, the trial court shall have liberty to cancel his bail bonds.

(2) If the petitioner tampers

(3) If the petitioner is found involved in similar nature of offence, after his release on bail the trial court shall take steps to cancel his bail bonds.
