JUSTICE ARUN KUMAR ORAL ORDER 09-05-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Silao PS Case No. 3 of 2018 registered under Sections 414, 411 of the IPC and Sections 25(1-b)a, 26, 35 of the Arms Act.

The allegation in brief is that stolen mobile and sim was detected to be used by one Dilip Kumar, who disclosed that the same was given by Pankaj Kumar and in the confessional statement he accepted his guilt and also disclosed name of Barun Kumar, son of the petitioner to be involved in the theft of the mobile, even his house was raised and ten mobiles and one country made rifle with two live cartridges were recovered.

Learned Counsel for the petitioner submits that Pankaj Kumar only disclosed name of son of the petitioner as one of the associates involved in the theft of mobile and the petitioner being father of Barun has been made accused as recovery was made from the house of the petitioner, the petitioner has no other criminal antecedent except one case under Section 302 IPC of the year 2003. No.28027 of 2018 (2) dt.09-05-2018 petitioner, namely, Rajendra Singh @ Rajjan Singh @ Rajan Singh is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Nalanda at Biharsharif in connection with Silao PS Case No. 3 of 2018.
