JUSTICE ARUN KUMAR ORAL ORDER 09-05-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 21.2.2018, seeks bail in Bihar PS Case No. 68 of 2018 registered under Sections 457 and 380 of the IPC.

The allegation in brief is that the informant had handed over key of his house to the petitioner for running water pump and when he returned back in the morning he found that theft was committed in his flat so he raises suspicion against the petitioner. Learned Counsel for the petitioner submits that the petitioner is a tenant in the informant's house, merely on suspicion because key was given to the petitioner so he has been made accused while unknown miscreants have committed theft by breaking open lock, the petitioner is a student and has clean antecedent. Having considered the said facts and circumstances, the petitioner, namely, Amit Kumar @ Righan Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Nalanda in connection with Bihar PS Case No. 68 of 2018.
