The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272, 273, 120B of the Indian Penal Code and 47A of the Excise Act.
The prosecution case is that a Pickup Van was intercepted, the driver managed to escape but two persons were apprehended namely Fulendra Kumar and Teja Kumar, who suggested that this van belonged to this petitioner and Shambhu Singh and Shankar Singh are traders of the recovered illicit 800 liters of spirit. It is submitted by the learned counsel for the petitioner that from the prosecution case it appears that the petitioner was not travelling in the van in question and
Patna High Court Cr.Misc. No.21379 of 2015 (2) dt.23-06-2015 he is simply a owner of the public carrier. Moreover the apprehended accused suggested that the seized spirit belongs to Shambhu and Shankar Singh.
Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Chapra at Saran in connection with Isuapur P.S. Case No. 01 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code. (Dinesh Kumar Singh, J) P.K./- U T
