JUSTICE ASHUTOSH KUMAR ORAL ORDER 26-05-2022 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks bail in anticipation of his arrest in connection with Bandeya P.S. Case No. 30 of 2018 dated 30.09.2018 instituted for the offences under Sections 135 of the Indian Electricity Act, 2003.

The petitioner is said to have caused losses to the State exchequer by an amount of Rs. 91,954/- for having misused the electric connection for irrigating his field. The learned counsel for the petitioner has submitted that such accusation is absolutely false and misdirected. However, he is ready to deposit Rs. 30,000/- subject

Patna High Court CR. MISC. No.25886 of 2021(2) dt.26-05-2022 2/2 to his rights and contentions later before the court below, which would be adjusted against the amount which might be found to be due to the electricity department.

Considering the afore-noted submission on behalf of the petitioner, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt / production of a copy of this order upon depositing an amount of Rs. 30,000/- under protest and subject to his rights and contentions later before the court below as well as on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Electricity, Gaya in connection with Bandeya P.S. Case No. 30 of 2018, subject to the condition laid down under Section 438

(2) of the Code of Criminal Procedure.
