Heard learned counsel for the petitioner and learned counsel for the respondent-State.

The petitioner was taken on a three month tenure employment, which was to end automatically. The appointment was by a letter dated 15-05-2021 (Annexure- 1), as a 'Lab Technician' at the Community Health Centre in Saharsa. 3.
Learned counsel for the petitioner submits that the State Health Society has come out with a letter dated 03-012023 (Annexure- 5), whereby the District Health Officials and the Medical College Hospitals have been given liberty to
Patna High Court CWJC No.4832 of 2023(3) dt.07-10-2023 2/2 engage such services of the MBBS Doctors, Lab Technicians and A.N.M.'s as per requirement, after making an assessment of the manpower available.

The letter of the State Health Society, at best enables the petitioner's engagement, if required. It does not vest any right in the petitioner. The earlier engagement under letter dated 15-05-2021(Annexure- 1), came to an automatic end after three month. Therefore, it will be open to the Authorities to engage the petitioner's services as per requirement in terms of policy decision. The petitioner would be at liberty to avail such opportunity, should the same come his way.
