The petitioners are apprehending arrest in a case registered for the offences punishable under Section 302/34 of the Indian Penal Code.
On recovery of dead body of the father of the informant with injuries suspicion was raised against the petitioners, leading to registration of FIR against them.
It is submitted by learned counsel for the petitioners that no reason has been assigned by the informant for raising suspicion against the petitioners. The impugned order suggest statement of the witnesses collected during investigation that they have supported the version of the informant, hence, there is no
Patna High Court Cr.Misc. No.16735 of 2016 (2) dt.19-04-2016 2/2 eye witness to the occurrence. The post mortem reflects one abrasion on the left side of head and other bruise of marginal size on the left side of eye brow which appears to have caused by hard and blunt substance. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the suspicious nature of accusation, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM, (West), Muzaffarpur, in connection with Sahebganj P.S.
Case No.214/2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
