====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-09-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with Dalsinghsarai P.S. Case No. 138 of 2014 for the offences punishable under Sections 394, 411 of the Indian Penal Code and Section 25(1-B)A, 26 and 35 of the Arms Act.

The case of the prosecution is that co-accused Surendra Das was fleeing away after stealing the motorcycle and during the course thereof, he was apprehended by the villagers and in his confessional statement, he has named the petitioner herein. The learned counsel for the petitioner submits that the petitioner has a clean antecedent and the main accused, namely, Surendra Das, who has named the petitioner in his confessional statement, has already been granted regular bail by

Patna High Court Cr.Misc. No.45757 of 2017 (2) dt.20-09-2017 2/2 order dated 2.12.2015 passed in Cr. Misc. No. 42804 of 2015. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Dalsinghsarai, Samastipur in connection with Dalsinghsarai P.S. Case No. 138 of 2014. (Mohit Kumar Shah, J) BTiwary/- U T
