JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-04-2016 Heard learned counsels for the petitioner and the State. The petitioner being the younger brother of the husband of the informant is apprehending arrest in a case registered for the offences punishable under Sections 341,323,324,307,379,498A and 504/34 of the Indian Penal Code.
The basic accusation is of torture and making assault with farsa to the informant.
It is submitted by the learned counsel for the petitioner that the injury has been found to be simple in nature. There is no accusation of repeating the blow. It is further submitted that for the occurrence of 1.3.2015 the FIR was registered on 1.4.2015. Considering the delayed lodging of the case, let the above named petitioner be released on anticipatory bail in the
Patna High Court Cr.Misc. No.18958 of 2016 (2) dt.29-04-2016 2/2 event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM, Saran at Chapra in connection with Baniyapur P.S. Case No.60 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
