Petitioner seeks bail in Nawanagar P.S. Case No.19 of 2019 instituted for the offence under Section(s) 379, 411/34 Indian Penal Code.

Counsel for the petitioner submits that petitioner and the informant have mobile repairing shops. Instant case has been filed due to business rivalry.

In the written report, it is alleged that two mobile phones have been recovered from the shop of the petitioner for which he could not produce any paper.

Counsel for the petitioner submits that those mobiles were given for necessary repair and he does not take any paper

Patna High Court CR. MISC. No.15084 of 2019(2) dt.12-03-2019 2/2 from customers with regard to aforesaid mobiles. Petitioner is in custody since 22.01.2019 having clean antecedents.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar, in connection with Nawanagar P.S. Case No.19 of 2019, subject to the condition that both the bailors shall be close relative of the petitioner.
