Petitioner, already in custody, seeks bail in connection with Bairgania P.S. Case No.04 of 2016, registered under Section 392 of the Indian Penal Code.

It is submitted by learned counsel for the petitioner that FIR is against unknown and except the disclosure of the name of the petitioner by persons associated with the informant, there is no other material against the petitioner, neither any incriminating article has been recovered from his possession nor he was put on Test Identification Parade though he is in custody since 29.05.2017 and another co-accused Pramod Kumar has been granted anticipatory bail by a coordinate Bench of this Court vide

Patna High Court Cr.Misc. No.43478 of 2017 (2) dt.20-09-2017 2 /2 Cr. Misc. No.31496 of 2017 on 20.07.2017 and except one case registered under Section 307 IPC, this petitioner has got no other criminal antecedent.

Considering the said facts and circumstances, petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sitamarhi in connection with Bairgania P.S. Case No.04 of 2016.
