JUSTICE ASHUTOSH KUMAR ORAL ORDER 03-03-2020 The petitioner, who is in custody since 27.01.2020, seeks bail in connection with Jakkanpur P.S. Case No. 72 of 2020, dated 25.01.2020, instituted for the offence under Sections 341, 342, 323 and 354 of the Indian Penal Code and 37 (b)/37(c) of Bihar Prohibition and Excise (Amendment) Act, 2018. Though the allegations in the F.I.R. do make out a case under Section 354 of the Indian Penal Code as well as under the Bihar Prohibition Act, 2016 but the informant does not want to prosecute the petitioner any

It appears that there was some dispute with respect to giving or taking up of job and for that purpose, the case was lodged.

Learned counsel for the parties have stated before this Court that the dispute has now settled and no good purpose would be served in giving effect to the aforesaid prosecution.

For the reasons aforestated viz., the period of custody of the petitioner and the informant choosing not to prosecute the petitioner any further, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Patna in connection with Jakkanpur P.S. Case No. 72 of 2020.

The application stands allowed.
