JUSTICE RAVI RANJAN ORAL ORDER 02-05-2016 I have heard learned counsel for the petitioner, the State and the South Bihar Power Distribution Company Ltd.. The petitioner apprehends his arrest in a case registered for offences punishable under Sections 135 of the Indian Electricity Act.

Case is of theft of electricity of amount to Rs. 41,524/-. Admittedly, the petitioner has already deposited Rs. 15,000/-. It is submitted that the case is compoundable. Having regard to the facts and circumstances of the case, let the petitioner, namely, Md. Wasimuddin be released on bail in the event of arrest/surrender before the court below

Patna High Court Cr.Misc. No.17908 of 2016 (3) dt.02-05-2016 2/2 within a period of six weeks from today in Ara Nawada P.S. Case No. 240/2016, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure subject to the condition that the petitioner would further pay Rs. 6000/- in favour of the South Bihar Power Distribution Company Ltd. and obtain a receipt thereof. The receipt should be furnished at the time of furnishing bail bound and only after examining the same the bail bound would be accepted by the court below.
