JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-09-2017 Heard learned counsel for the petitioner as well as learned Additional Public prosecutor for the State. Earlier the prayer for bail of the petitioner was rejected by this Court vide order dated 06.12.2016 passed in Cr. Misc. No. 47147 of 2016 giving liberty to the petitioner to renew his prayer for bail after four months, if his trial is not concluded within the above stated period.

Learned counsel for the petitioner submits that charge against the petitioner was framed on 29.06.2017 but up till now not a single prosecution witness has been examined. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the above named, petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten

Patna High Court Cr.Misc. No.43246 of 2017 (2) dt.06-09-2017 2/2 Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate,1st class, Vaishali at Hajipur in connection with Hajipur Town P.S.Case No. 433 of 2016.
