The petitioner herein seeks anticipatory bail in Jagdishpur P.S. Case No. 37 of 2016 registered under Section 7 of the E.C. Act and further under Section 406, 409, 420 & 120(B) of the Indian Penal Code.

It is alleged that two trucks laden bags of wheat were seized. The petitioner is the owner of one truck laden with 503 bags of wheat. The wheat was made for distribution amongst beneficiaries under the Government scheme.

It is submitted that petitioner is the owner of the truck. He is merely the transporter. The laden wheat has been claimed

Patna High Court Cr.Misc. No.17054 of 2016 (2) dt.27-04-2016 2/2 by another person namely M/s Maha Maya Traders. This factum was also noted by the learned Sessions Judge in the impugned order. The petitioner does not carry criminal antecedents. In the facts and circumstances of the case, let the petitioner above named, in the event of arrest/surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned C.J. M. Bhagalpur in Jagdishpur P.S. Case No. 37/2016 on condition that one of the bailors shall be his own/close family member. The petitioner shall appear on each date fixed at the trial. In case of default in appearance on two consecutive dates, the trial court shall have liberty to cancel his bail bonds.
