JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 09-03-2022 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are apprehending his arrest in a case registered in connection with Harnaut P.S.Case No. 156 of 2020 for the offences punishable under Sections 7 of the Essential Commodities Act.

As per allegation in the F.I.R, petitioner along with other co-accused persons were selling the rice in black market from Tata Magic Van. When police raided, they fled away from the place of occurrence.

Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.27231 of 2021(3) dt.09-03-2022 2/2 petitioners are falsely implicated in this case. It is submitted that there is no complaint by the consumers in respect of none distribution of alleged rice. Petitioners have got no criminal antecedent.

Learned Additional Public Prosecutor opposed the bail prayer of the petitioner.

Considering the facts and circumstance of the case as well as submission of the parties, let the petitioner in the event of his arrest or surrender before the Court Below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda in connection with Harnaut P.S Case No. 156 of 2020 subject to the conditions as laid down under Section 438(2) of the Cr.P.C (Sunil Kumar Panwar, J) N.K/- U T
