Let the defect(s) be removed within four weeks of the complete start of the physical Court in normal course. The case is registered under Section 379 of the Indian Penal Code in connection with Dinara P.S. Case No. 208 /2021. As per the prosecution story, the informant has alleged that he went to the Indaur College with his motorcycle, parked it inside the college premises for filling of the form and when he came out, the motorcycle was missing. The investigation took place and name of the petitioner cropped up and accordingly he was taken into custody and is in jail since 1.11.2021 ( as stated in para-12 of the bail application).

Patna High Court CR. MISC. No.16370 of 2022(3) dt.13-09-2022 2/3 Learned counsel for the petitioner submits that he is innocent, is in custody since 1.11.2021 and has been implicated by the police.

Taking into consideration that the accused is in custody since 1.11.2021, charge-sheet stands submitted, this Court is inclined to grant him the privilege of bail subject to certain conditions in view of the fact that he has criminal antecedent.

Let the petitioner be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each in connection with Dinara P.S. Case No. 208 /2021 to the satisfaction of learned A.C.J.M. III, Bikramganj, District - Rohtas, subject to following conditions: (i) one of the bailor should be the family member of the petitioner, who shall provide official document to show his/her bona fide;

(ii) the petitioner shall appear on each and every date before the Trial court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail by the Trial court itself;

(iii) the petitioner shall appear before the concerned police station every fortnight for next six months to mark his

(iv) the petitioner shall desist from committing any criminal offence again failing which the State shall be at liberty to take steps for cancellation of his bail bonds. With the aforesaid observations, the bail application is allowed.
