The petitioner apprehends his arrest in Jagdishpur P.S. Case No. 37/2016, registered for the offence punishable under Sections 406, 409, 420, 120B of the Indian Penal Code and Section 7 of Essential Commodities Act.
Two trucks bearing no. BR-10G-1884 and DL-IGA6303 were intercepted loaded with wheat. It is submitted that the petitioner is the owner of truck bearing no. DL-IGA-6303. The wheat was claimed by one Maha Maya Traders. The wheat does not belong to Food Corporation of India (F.C.I.) on such condition wheat was released in favour of Maha Maya Traders. Patna High Court Cr.Misc. No.17143 of 2016 (2) dt.16-05-2016 2/2 10G-1884 namely, Santosh Kumar has already been granted anticipatory bail vide order passed in Cr. Misc. 17054/2016. The case of petitioner stands on the same footing. Considering the facts aforesaid, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Jagdishpur P.S. Case No. 37/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
