JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 409 and 420 of the Indian Penal Code.
The prosecution case is that the petitioner being collecting agent of energy charges on behalf of the Electric Supply Company could not deposit Rs.44159/-.
It is submitted by the learned counsel for the petitioner that the alleged amount has been deposited. Learned counsel for the South Bihar Power Distribution Co. Ltd. submits that since the statement has been made on affidavit to the effect that the alleged amount has been deposited by the petitioner, there is no reason to disbelieve the same.

No.18559 of 2016 (3) dt.03-05-2016 2/2 Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Bhagalpur in connection with Sahkund P.S. Case No.30 of 2016 subject to the conditions as laid down under Section 438(2) Cr.P.C.
