The petitioners are in custody since 17.06.2017 in connection with Muffasil P.S. Case No. 265 of 2017 for the offence registered under Sections 25 (i-b)a 26 & 35 of the Indian Penal Code.

Learned counsel for the petitioner submits that the alleged recovery was not made from his conscious possession. It is further submitted that certain recoveries of cartons of English wine were also made and two cases have been lodged for the same offence.

Considering the aforesaid facts and circumstances of

Patna High Court Cr.Misc. No.48669 of 2017 (2) dt.18-10-2017 2/2 the case, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Begusarai in connection with Mufassil P.S.
