The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 30(a), 30(ii), 34(ii), 38(ii) and 41(i) of the Bihar Excise Prohibition Amendment Act, 2018.

It is a case of recovery of country made wine from the vehicle of this petitioner.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that petitioner has clean antecedent. Learned APP appearing for the State opposed the anticipatory bail.

After considering the facts and circumstances of the

Patna High Court CR. MISC. No. 15393 of 2022(2) dt.25-08-2022 2/2 case that the wine was recovered from the vehicle of this petitioner, I am not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner is rejected.
