The petitioner seeks bail in Ghoshi P.S. Case No. 60 of 2016 registered under Sections 406, 409, 420, 467 and 468/34 of the Indian Penal Code.

As per the prosecution case, excess amount of GPF is said to have been withdrawn by some persons in collusion of the petitioner.

It is submitted by learned counsel for the petitioner that the petitioner was head clerk of the Okari Primary Health Centre and he had prepared bill on the order given by the medical officer. The said medical officer has been enlarged on bail by this

Patna High Court Cr.Misc. No.45921 of 2017 (2) dt.19-09-2017 2/2 court by order dated 07.04.2017 in Cr. Misc. 16334 of 2017. Moreover, the entire excess amount withdrawn earlier has been deposited by the different beneficiaries. Similarly situated coaccused Birendra Kumar Singh has been enlarged on bail by a coordinate bench of this court vide order dated 12.07.2017 passed in Cr. Misc. No. 21754 of 2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Jehanabad in connection with Ghoshi P.S.
