The petitioner seeks bail in anticipation of his arrest in connection with Didarganj P.S. Case No. 89 of 2018, Special Case No. 5549 of 2018 dated 14.06.2018 instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. It appears from the prosecution report that 30 litres of liquor kept in a jute bag was recovered from a motorcycle. The registration of the motorcycle is in the name of the petitioner.

It has been urged on behalf of the petitioner that he is a retired person and his motorcycle is being used by his son. The petitioner had a recent paralytic attack and is almost immobile presently.

Considering the nature of accusation against

No.14782 of 2020(2) dt.11-06-2020 2/2 the petitioner and taking into account that he is a person of clean antecedent, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna in connection with Didarganj P.S. Case No. 89 of 2018, Special Case No. 5549 of 2018 subject to the conditions as laid down under Section 438(2) Cr.P.C. (Ashutosh Kumar, J) krishna/- U T
