The petitioner apprehends his arrest in a case registered for the offence under Section 307, 379 & other allied sections of the Indian Penal Code.

As per F.I.R., this petitioner assaulted the informant by means of rod, as a result of which, he sustained head injury. It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case and doctor has not opined about nature of injury allegedly caused by this petitioner. There is no allegation of repetition of blow. Petitioner has no criminal antecedent.

However, learned A.P.P. for the State opposed the bail petition and submitted that there is specific allegation of commission of assault against this petitioner causing head

Considering the same, the prayer for anticipatory bail of petitioner is rejected.
