JUSTICE SUDHIR SINGH ORAL ORDER 02-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 376 and 323 of the Indian Penal Code. It is alleged by the informant that while she was sleeping in her house, the petitioner entered into the house of the informant and forcibly committed rape upon her.
On behalf of the petitioner it has been submitted that the petitioner has got no criminal antecedent and he has been falsely implicated in the p`resent case. The relations of the victim have been examined in paras 6,7 and 8 of the case diary and they have claimed that they came to know regarding the said incident from the informant. There is no eye witness to the occurrence nor there is any medical report to support the allegation.
Patna High Court Cr.Misc. No.22485 of 2015 (3) dt.02-09-2015 2/2 On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri S.Ram, learned J.M., 1st Class, Supaul in connection with Supaul Mahila P.S.Case No.76/2014, subject to the conditions as laid down u/s 438(2) Cr.P.C.
